The recording industry's music piracy fight was dealt a setback Tuesday when a federal judge rejected the RIAA's "making available" argument in a lawsuit against a husband and wife accused of copyright infringement.

In Atlantic v. Howell, Judge Neil V. Wake denied the labels' motion for summary judgment in a 17-page decision (PDF), allowing the suit to proceed to trial. The argument--that merely the act of making music files available for download constituted copyright infringement--has been the basis for the Recording Industry Association of America's legal battle against online music piracy.

"The court agrees with the great weight of authority that section 106(3) is not violated unless the defendant has actually distributed an unauthorized copy of the work to a member of the public," wrote the judge in his order. "Merely making an unauthorized copy of a copyrighted work available to the public does not violate a copyright holder's exclusive right of distribution."

EFF staff attorney Fred von Lohmann called the order the "most decisive rejection yet of the recording industry's 'making available' theory of infringement."

The order is a bit of an oddity in that it's a reversal of an order Wake issued in August, in which he granted the RIAA's summary judgment and fined the Howells $40,850 in penalties and court costs. However, the Howells appealed and the judgment was later vacated.

Supreme Court upholds photo ID law for voters in Indiana

WASHINGTON - The Supreme Court ruled Monday that states can require voters to produce photo identification without violating their constitutional rights, validating Republican-inspired voter ID laws.

In a splintered 6-3 ruling, the court upheld Indiana's strict photo ID requirement, which Democrats and civil rights groups said would deter poor, older and minority voters from casting ballots. Its backers said it was needed to prevent fraud.

Hillary and ObamaI didn't think I'd actually agree with this line of thought, but after reading through this blog article on Slate, I have to say it makes a lot of sense.  Obama should drop out.  He should drop out NOW.  Get out of the race and let the chips fall where they may.

Can you squeeze that a little tighter pleaseOver the last several years 'Cable' TV had a nice advantage over their satellite competitors, primarily thanks to the limited bandwidth that is available for distribution of television programming sent over satellite.  With satellite TV service (DirecTV and Dish Network) there were only so many channels worth of capacity and the only way to deliver more channels was to squeeze the content into the limited bandwidth, similarly to overloading the freeway with more and more vehicles with each vehicle riding closer and

The Washington Times has an interesting article in their Saturday 19 April 2008 edition. Front page (of all places).  In the article lies the answer for where the heck is all of the HD content that purchasers of nice, fancy (and not so fancy), new HD capable televisions should be looking for.  Short answer: delayed because of costs

So, I'm seeing a story running on CNN (yeah, every now and then I can't avoid seeing content from that particular outlet) about how U.S. Presidential candidate and erstwhile U.S. Senator from Arizona John McCain wants to help provide an even bigger and better stimulus for the U.S. economy ... by suspending (I assume) Federal gasoline taxes over the summer.

Wrong AnswerThis coming from the same John McCain that has complained about pork barrel politics and government handouts (as well as deficit spending) for years and years.  Apparently he 'woke up' while dreaming happy thoughts about perhaps being the next President of the United States, and realized that the U.S. economy is hurting and needs an even greater stimulus than what the tax pre-bate that is coming next month will really provide.  Further, he seems to have been influenced by the likes of the Travel Industry Association (http://www.tia.org/) and others that preach that travel is one of the big cogs in the U.S. economic machine.

I don't necessarily disagree with the idea that travel is important to the U.S., and I really don't like paying more in taxes than I have to, but I still think McCain -- and anyone else that wants to talk about reducing the gasoline tax -- is completely wrong here.  In fact, I've said before, and still stand by those words, that we should be raising gasoline taxes and letting nature take it's course in DISCOURAGING unnecessary travel in this country.  We must reduce gasoline consumption (as we continue to explore and develop alternative fuels for powering our transportation desires and needs) and the sooner we can do it and get to a point where we can tell a bunch of middle-easterners that they can keep their friggin' oil while we keep our corn and other food products (or sell those same products to them at greatly inflated prices) the better off we'll be.

McCain clearly has good intentions here, and yes, leaving money in consumers pockets is a good idea, but then again no sooner would the extra money from suspending the gasoline taxes be in our pockets than we'd be turning around and questioning why the tax man is digging even deeper in those same pockets to get money for fixing roadways, bridges, and other 'infrastructure' needs across the country.  Touching the gasoline taxes (other than perhaps to raise them to discourage unnecessary travel) is just the wrong idea, even if it seems to be the right time for it.

What comes first the 64-bit apps or the 64-bit OS?  Well, in the case of a fairly logical world, the 64-bit OS would come along with plans for 64-bit apps to be released soon on the heals of the operating system release, and certainly with the understanding that all apps released for the 32-bit OS should run just fine on the 64-bit OS even if they don't take advantage of the 64-bit features.  Sadly that isn't necessarily the case with Microsoft's Windows Vista operating system.

Oh, certainly Vista (and XP before it really) were released in a 64-bit flavor.  Heck, there's also 64-bit versions of Windows Server 2003 and later Windows Server 2008.  Yay for the 64-bit operating system.  Unfortunately, well, there's the problem of where the heck are the 64-bit applications, and worse still, why are there still too many applications that work on the 32-bit operating system but not at all or with seriously reduced functionality when run on the 64-bit version of the same operating system.

News today (April 14, 2008) that Blockbuster has made an unsolicited bid to buy consumer electronics chain Circuit City.

Would it be wrong of me to ask why?  Was Blockbuster not finding enough lamers to work in their stores and for some reason assuming that they could just resupply with the employees from Circuit City?

I'm saddened with the passing of Charlton Heston, the actor and former head of the NRA.  Heston was a great actor, and a great man.  Those that are inclined to do so should do a little research on Heston and his involvement in the civil rights movement, and perhaps some more investigation into his real positions on gun control and the like.  Though Heston was the leader of the NRA later in his life, he was long ago associated with those that we now consider some of our more liberal leaders.

I could care less if Chevy sold cars through their promotions or not, but I'm more than happy to help them spend money on a worthwhile charity.
